Objects to perform

According to Article 66, Circular 02/2022/TT-BTNMT stipulates:

  • Owners of investment projects, production, business and service establishments are required to have environmental license as prescribed in Form No. 05.A Appendix VI issued together with this Circular.
  • Owners of investment projects, production, business and service establishments are subject to: environmental registration as prescribed in Form No. 05.B Appendix VI issued together with this Circular.
  • Investors build and operate infrastructure in production, business and service centers or industrial clusters according to the provisions of Form No. 06, Appendix VI issued together with this Circular.
  • The object is free environmental registration According to the provisions of Article 32 of Decree No. 08/2022/ND-CP, the report on environmental protection is not required.

Contents of the report on environmental protection

Reports subject to environmental permits:

- General information:

– Part 1: Results of environmental protection works and measures: Wastewater, emissions (Main treatment works, results of periodical monitoring, continuous automatic monitoring,...), common solid waste management, hazardous waste, medical waste, prevention and response to environmental problems, management of persistent pollutants.

– Part 2: Situation of collection, transportation and treatment of MSW, IWW, and HW. (This section only applies to the owner of the collection, transport and treatment of MSW, IWW, and HW)

– Part 3: Situation of importing scrap. (This section only applies to establishments that use imported scrap as raw production materials.)

– Part 4: The situation of implementing environmental rehabilitation and restoration for mineral mining activities according to regulations. (This section only applies to organizations and individuals exploiting minerals).

the agency receiving the report on environmental protection

  • Pursuant to Clause 5, Article 66, Circular 02/2022/TT-BTNMT stipulates as follows:

a) Owners of investment projects, production, business and service establishments shall send reports on environmental protection to the following agencies: 

  • The environmental licensing agency (for the subjects specified at Point a, Clause 1 of this Article) or the environmental registration receiving agency (for the subjects specified at Point b, Clause 1 of this Article); 
  • Department of Natural Resources and Environment (where the investment project is located, the establishment has production, business and service activities); 
  • District-level People's Committees; 
  • Investors in construction and business of technical infrastructure in concentrated production, business and service zones or industrial clusters (for establishments located in economic zones, concentrated production, business and service zones) or industrial clusters);

b) Investors in construction and business of technical infrastructure of concentrated production, business and service zones shall send reports on environmental protection to the agencies as prescribed at Point m, Clause 4, Article 51 of the Law on Protection. environmental protection;

c) Investors in construction and business of technical infrastructure of industrial clusters shall send reports on environmental protection to agencies as prescribed at Point l, Clause 3, Article 52 of the Law on Environmental Protection.

  • Owners of investment projects, production, business and service establishments shall send annual reports on environmental protection work (report period from January 1 to the end of December 31) to relevant agencies. before January 15 of the following year.
